Can a contract with a Pakistani party be governed by foreign law?
Generally yes. Parties can choose a foreign governing law and a foreign or arbitral forum. What matters is enforceability: a foreign judgment is harder to enforce in Pakistan than an arbitral award, which is why arbitration is often the pragmatic choice.
